Oregon Appeals Court Rules that Measure 114 is Constitutional

On March 12, 2025, the Oregon Court of Appeals ruled that Measure 114, a gun control law approved by voters in November 2022, is constitutional, overturning a previous decision by a Harney County Circuit Court judge who had blocked its implementation.
Measure 114 introduces several key provisions aimed at enhancing gun safety:

Permit-to-Purchase Requirement: Individuals must obtain a permit to purchase firearms, which involves completing a gun safety training course and passing a criminal background check.

Ban on High-Capacity Magazines: The sale, transfer, and importation of magazines capable of holding more than ten rounds of ammunition are prohibited.

Overturns the "Charleston Rule": Allowing a firearm transfer to proceed if a background check takes more than three days for a ruling (approved/denied).
While the appellate court's ruling marks a significant step forward for Measure 114, the law will not take immediate effect. Opponents have a 35-day window to seek further appellate review.
